Earth Heir Tour Guide Referral Policy

1. Purpose and Scope

Earth Heir Sdn Bhd ("Earth Heir," "we," "us") operates this Tour Guide Referral Programme to reward registered tour guides who introduce genuine retail customers to our outlets. This policy sets out the terms governing eligibility, attribution, calculation, and payment of referral fees. It applies to all participating tour guides and supersedes any prior verbal or written arrangement.

2. Eligibility

To participate, a tour guide must:

• Be registered with Earth Heir and issued a unique individual referral code.
• Provide accurate contact and payment details (full name, contact number, and bank account details for payout).
• Bring genuine, walk-in guests who make a purchase of their own free will.

Earth Heir reserves the right to approve, decline, suspend, or revoke any tour guide's participation at its sole discretion.

3. Referral Fee

The referral fee is 10% of net sales generated by qualifying guests introduced by the tour guide. Net sales are defined as the final transaction value after all discounts, promotions, tax (SST), and any returns or refunds have been deducted. The fee excludes shipping, gift-wrapping, service charges, and any non-merchandise fees.

4. Individual Referral Code and Attribution

Each participating tour guide is issued a unique individual referral code. This code is personal, non-transferable, and must not be shared, sold, or lent to any other party.

For a sale to be attributed to a tour guide, the guide (or their guest) must:

• Present the individual referral code at the point of sale, and
• Inform the cashier or Earth Heir staff before the transaction is keyed in.

5. Responsibility and Non-Attribution

It is solely the tour guide's responsibility to ensure the referral code is provided and recorded before payment is processed.

• Earth Heir is not responsible for any sale that is not attributed due to failure, oversight, or negligence in providing the code.
• Once a transaction has been keyed in without a code provided, Earth Heir reserves the right not to recognise that sale for referral purposes.
• Codes cannot be applied retroactively. No adjustments will be made to completed transactions.

6. Same-Day Requirement

Only purchases made by guests on the same calendar day they are brought in by the tour guide qualify for the referral fee. Purchases made on any subsequent day, or by returning customers on their own, do not qualify.

7. Qualifying and Excluded Sales

A sale qualifies only where a genuine guest, personally introduced on that day, completes a bona fide retail purchase using the correct individual code.

The following are excluded and earn no referral fee:

• Sales without a valid code recorded at the point of transaction.
• The tour guide's own purchases or purchases made on their behalf.
• Cancelled, refunded, exchanged, or charged-back transactions (a fee already paid on such a sale will be deducted from future payouts).
• Corporate, wholesale, consignment, B2B, or online orders.
• Sales involving a code obtained or used fraudulently.

8. Payment Terms

• Referral fees are calculated and paid once a month, covering qualifying sales in the preceding calendar month.
• Payment is made by bank transfer or cash.
• A minimum payout threshold of RM50 applies. Balances below RM50 will be carried forward and accumulated until the threshold is met.
• Payment is conditional on the tour guide providing valid, accurate payout details. Earth Heir is not liable for payments delayed or misdirected due to incorrect details supplied by the guide.
• The tour guide is responsible for any personal tax obligations arising from referral fees received.

9. Anti-Abuse and Fraud

Earth Heir reserves the right to withhold or reclaim any fee, and to suspend or terminate participation, where it reasonably suspects:

• Sharing or misuse of the individual code.
• Fabricated, self-generated, or artificially split transactions to inflate fees.
• Coercion or misleading of customers, or any conduct that harms Earth Heir's reputation or its Fair Trade and ethical commitments.

Earth Heir's determination of what constitutes abuse is final.

10. Records and Disputes

Earth Heir's transaction records are the definitive basis for calculating referral fees. Any dispute regarding an unattributed or miscalculated sale must be raised in writing within 14 days of the relevant month's payout. Disputes raised after this period will not be entertained.

11. Amendment and Termination

Earth Heir may amend, suspend, or terminate this policy, the programme, or any individual code at any time, with or without notice. Continued participation after any change constitutes acceptance of the revised terms.

12. Acknowledgement

By participating in the programme and using an issued referral code, the tour guide confirms they have read, understood, and agreed to this policy.
